Terms

Welcome to M & N Art. These Terms & Conditions govern your use of mandnart.com and your interactions with M & N Art, including purchases of artwork, registration for classes or events, use of website content, and other products or services we may offer.

By accessing or using this website, placing an order, registering for a class, or otherwise using our services, you agree to these Terms & Conditions. If you do not agree with these terms, please do not use the website or services.

1. About M & N Art

M & N Art is an art gallery and creative studio based in Venice, Florida. The website may feature original artwork, mixed-media pieces, artist profiles, exhibitions, classes, workshops, events, and other art-related products and services.

2. Website Use

You may use mandnart.com for lawful personal and commercial purposes related to viewing artwork, learning about artists, purchasing available works, registering for classes or events, and contacting M & N Art.

You agree not to:

  • Use the website for unlawful, fraudulent, or abusive purposes
  • Attempt to gain unauthorized access to the website or its systems
  • Interfere with the security or operation of the website
  • Introduce malicious software, automated attacks, or harmful code
  • Scrape or systematically copy website content without permission
  • Misrepresent your identity or affiliation with another person or organization
  • Use artwork, images, text, or other content in violation of intellectual property rights

3. Artwork Availability

Original artwork is generally one of a kind. Availability may change at any time, including when a work is sold through the gallery, at an exhibition, through another authorized sales channel, or directly by the artist.

We make reasonable efforts to keep website availability accurate, but an artwork appearing as available online is not guaranteed to remain available until a purchase has been confirmed.

If an artwork becomes unavailable after an order is submitted, we may cancel the transaction and issue a refund for any amount paid for that unavailable item.

4. Artwork Images, Colors, and Appearance

We make reasonable efforts to present artwork accurately. However, photographs and digital displays cannot perfectly reproduce every color, texture, metallic finish, reflective surface, brushstroke, dimensional element, or material used in an original work.

Colors may also appear differently depending on your screen, device, lighting, browser settings, and display calibration.

These natural differences are especially relevant to textured, metallic, reflective, resin, mosaic, and mixed-media artwork.

5. Pricing

Prices displayed on mandnart.com are listed in U.S. dollars unless otherwise stated.

M & N Art may change prices at any time before a purchase is completed. Changes will not affect an order that has already been accepted and paid for.

Applicable sales tax, shipping, delivery, insurance, framing, installation, or other charges may be added where applicable and will normally be disclosed before the transaction is completed.

6. Orders and Payment

Submission of an order does not necessarily mean that the order has been accepted. We reserve the right to decline or cancel an order in circumstances including pricing errors, artwork availability issues, suspected fraud, payment problems, or other legitimate business reasons.

Payments may be processed through third-party payment providers. Your use of those payment services may also be subject to the provider’s own terms and privacy policies.

7. Original Artwork

Unless specifically described otherwise, artwork identified as an “original” is an original physical work rather than a reproduction.

Original artwork may contain natural variations, visible brushwork, texture, irregularities, handmade elements, or characteristics of the materials used. These qualities are part of the artwork and are not necessarily defects.

8. Shipping and Delivery

Shipping times and delivery estimates are estimates only and may vary based on artwork size, packaging requirements, destination, carrier availability, weather, holidays, or other circumstances outside our control.

Large, fragile, textured, framed, or dimensional works may require specialized packing, shipping, delivery, or pickup arrangements.

Customers are responsible for providing accurate shipping and contact information. Additional costs caused by an incorrect or incomplete address may be the responsibility of the customer.

9. Damaged Shipments

If artwork arrives visibly damaged, please photograph the packaging and artwork before discarding any materials and contact M & N Art as soon as reasonably possible.

Photographs, packaging, shipping labels, and other documentation may be required to submit a claim with the shipping or insurance provider.

10. Returns, Exchanges, and Cancellations

Return, exchange, and cancellation terms may vary depending on the type of artwork, product, class, workshop, event, commission, or service purchased.

Any specific return or cancellation policy presented on the applicable product, artwork, class, workshop, event, checkout, invoice, or registration page will apply to that transaction.

Custom artwork, commissioned work, personalized items, and certain original artworks may not be eligible for cancellation or return once work has begun or the transaction has been completed.

Please contact M & N Art promptly if you have a problem with a purchase so we can review the circumstances.

11. Classes, Workshops, and Events

M & N Art may offer art classes, workshops, demonstrations, exhibitions, special events, and other educational or creative programs.

Class schedules, instructors, materials, locations, and availability may occasionally change. When reasonably possible, we will communicate significant changes to registered participants.

Some programs may have minimum or maximum enrollment requirements. M & N Art may cancel or reschedule a class or event when necessary.

12. Art Materials and Studio Participation

Art classes and studio activities may involve paints, brushes, cutting tools, adhesives, solvents, pigments, resins, glass, mirrors, natural materials, sculptural materials, or other tools and supplies depending on the activity.

Participants are expected to follow reasonable instructions regarding the safe use of materials, equipment, and studio spaces.

Participants should inform M & N Art before a class if they have known allergies, sensitivities, mobility considerations, or other concerns relevant to materials or participation.

13. Minors

Children and teenagers may participate in classes or events specifically offered for their age group or where participation by minors is otherwise permitted.

Registration for a minor should be completed or authorized by a parent or legal guardian. Additional permission, emergency contact, pickup, photography, or participation forms may be required for certain programs.

14. Commissions and Custom Artwork

Commissioned and custom artwork may be subject to additional terms concerning deposits, pricing, revisions, completion schedules, materials, shipping, approval, and cancellation.

Any written commission agreement, proposal, invoice, or project-specific terms provided for a custom artwork will control where those terms differ from these general Terms & Conditions.

15. Copyright and Ownership of Artwork

Purchasing an original artwork transfers ownership of the physical artwork only. Unless expressly agreed otherwise in writing, copyright and other intellectual property rights remain with the artist or applicable rights holder.

Purchasing artwork does not automatically grant the purchaser the right to reproduce, publish, distribute, merchandise, license, commercially exploit, or create derivative works from the artwork.

Collectors may photograph artwork for ordinary personal, noncommercial purposes, such as displaying the work in their home or sharing their collection socially, provided the use does not imply ownership of the copyright or commercial licensing rights.

16. Website Content and Intellectual Property

Unless otherwise indicated, the content on mandnart.com, including text, photographs, graphics, logos, design elements, artist biographies, artwork images, and other materials, is owned by or used with permission by M & N Art, participating artists, photographers, or other rights holders.

Website content may not be copied, republished, reproduced, distributed, commercially exploited, or used to train or create competing commercial content without appropriate authorization from the applicable rights holder.

17. Artist Rights

Artwork displayed or sold through M & N Art may remain protected by copyright and other intellectual property laws after the physical artwork has been sold.

Artists may retain rights to photograph, reproduce, publish, display, promote, or otherwise use images of their own artwork unless a separate written agreement provides otherwise.

18. Third-Party Links and Services

Mandnart.com may contain links to artist websites, social media platforms, payment processors, shipping providers, or other third-party services.

M & N Art does not control and is not responsible for the availability, security, content, terms, products, services, or privacy practices of third parties.

19. Photography and Promotional Use

Photographs or video may occasionally be taken during exhibitions, public events, classes, workshops, and other gallery activities.

These materials may be used for documentation, website content, social media, advertising, or promotion of M & N Art and its programs, subject to applicable law and any specific permissions required.

20. User Submissions

If you submit photographs, testimonials, reviews, artist materials, artwork information, or other content to M & N Art for publication, you represent that you have the right to provide that content.

Where you specifically submit content for publication or promotion, you grant M & N Art permission to use that content for the intended gallery, website, marketing, exhibition, or promotional purpose.

21. Disclaimer of Warranties

Mandnart.com and its website content are provided on an “as available” basis to the extent permitted by law.

While we make reasonable efforts to maintain accurate information, we do not guarantee that every description, image, price, measurement, availability status, or website feature will always be complete or error-free.

22. Limitation of Liability

To the fullest extent permitted by applicable law, M & N Art will not be liable for indirect, incidental, special, consequential, or punitive damages resulting from use of the website, inability to use the website, third-party services, or circumstances outside our reasonable control.

Nothing in these Terms & Conditions excludes or limits liability that cannot legally be excluded or limited.

23. Indemnification

To the extent permitted by law, you agree to be responsible for losses, claims, or expenses resulting from your unlawful misuse of the website, violation of these Terms & Conditions, or infringement of another person’s rights.

24. Governing Law

These Terms & Conditions are governed by the laws of the State of Florida, without regard to conflict-of-law principles.

Any dispute that must be resolved through legal proceedings will be handled in an appropriate court with jurisdiction in Florida, unless applicable law requires otherwise.

25. Changes to These Terms

M & N Art may update these Terms & Conditions periodically to reflect changes in our website, services, business practices, or legal requirements.

Updated terms will be posted on this page with a revised effective date. Continued use of the website after an update constitutes acceptance of the revised terms to the extent permitted by law.

26. Severability

If any provision of these Terms & Conditions is found to be invalid or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.

27. Entire Agreement

These Terms & Conditions, together with our Privacy Policy and any transaction-specific terms provided at the time of purchase, registration, commission, or service, constitute the applicable agreement between you and M & N Art regarding use of the website and related services.
